Qualitätsanalyse österreichischer Gutachten zur Zurechnungsfähigkeit und Gefährlichkeitsprognose von Sexualstraftätern
In the present study the quality of 211 psychiatric and psychological expert assessments concerning criminal responsibility and prediction of future dangerousness of sexual offenders in Austria were examined. A coding system was developed to evaluate formal as well as contentual quality of the assessments. A number of shortcomings concerning form and content could be found: often a sexual history was missing, or the line of reasoning was not transparent, the reports contained "pseudo theories", moralizing and normative judgements or inappropriate descriptions as in psychopathological wording. Contrary to the expectation the reports of frequently assigned expert witnesses tended to contain more quality deficiencies than reports of rarely assigned expert witnesses. Based on the results suggestions for improving the quality of forensic expert assessments were formulated.
